6 precautions for signing decoration contract

  • Detail

Now the home decoration market is very prone to engineering disputes, such as subcontracting, affiliated companies, decoration quality, delay in construction period, budget and final settlement disputes, etc. Lawyer Chen reminded consumers that in order to prevent such disputes, owners must sign a "home decoration contract" to ensure their own interests. When signing a contract, they should pay more attention to the following aspects

1. Check the identity of the parties to the decoration contract. The decoration house of the employer in the decoration contract shall be a legal residential house, that is, a property right house or a rental house; The contract contractor shall be an enterprise legal person with decoration construction qualification approved and registered by the administrative department for Industry and Commerce and approved by the competent construction department. In addition, the decoration contract shall specify the decoration construction site and area

2. Specify the construction content and contracting method of room decoration. The construction content and requirements of room decoration is one of the main contents of the home decoration contract. If the terms in this regard are too general, it is often easy to cause construction disputes. Therefore, the construction content should be specific and clear, and the decoration content, materials used, specific construction requirements and contracting methods should be written clearly according to the decoration part of the room

3. Indicate the work price, payment method and construction period. No matter what kind of contracting method is adopted, the labor price in the contract should be clearly written and cannot be vague. The total price in the contract includes material cost, labor cost, management fee, design fee, garbage removal fee, other expenses and taxes. The tax shall be borne by the owner, which is a special requirement of the decoration industry. The payment method and time limit of the project price should be clearly agreed in the contract to avoid disputes. The date of commencement and completion is one of the essential contents of the contract, which often involves the determination of liability for breach of contract, so it should be stated in the contract and strictly observed

4. Specify the agreed content of material supply in detail. The agreement on material supply is an important issue related to the quality of home decoration and project funds. Therefore, the name, brand, specification, model, quality grade, unit, quantity and unit price of the materials shall be specified in detail on the material list in the annex to the contract, whether the materials are contracted or not. The time and place of delivery of materials shall be clearly stated on the material supply list

5. The quality completion acceptance standard shall be in accordance with the legal standard. The terms of quality and completion acceptance standards in the contract must comply with the scope allowed by the relevant provisions of the relevant competent government departments. It should be noted that since home decoration should meet the different needs of multiple levels, the same room type often has different levels of decoration, so it is impossible and should not apply the same standard to different levels of decoration

6. The responsibility for breach of contract and the way of dispute settlement should be clarified. The liability for breach of contract is opposite to the obligations and responsibilities of both parties to the contract. After the contract is concluded, both parties should strictly perform the obligations agreed in the contract, otherwise they should bear the corresponding liability for breach of contract. For the settlement of disputes, it can be agreed to request mediation from the local building decoration Association, or complain to the local construction department or the Consumer Association. If negotiation and mediation fail, it can be agreed to apply for arbitration or bring a lawsuit to the court
